For the first time in France, the causal link between air pollution and respiratory diseases is recognized by a Court!
Under the terms of two decisions dated June 16, 2023, the Paris Administrative Court recognized a causal link between air pollution and the health problems, particularly respiratory, of several children. The plaintiffs had taken legal action to seek compensation for their damage, citing the State’s culpable failure to address air pollution.
After emphasizing that it “results […] from the investigation that part of the symptoms from which [the children] suffered was caused by the exceeding of the pollution thresholds resulting from the fault of the State”, the Court ordered the State to pay damages of €2,000 and €3,000. »
